RECENT COURT OF APPEALS FOR VETERANS CLAIMS DECISION

 

In a recent CAVC decision, Hass vs. Nicholson August 16, 2006 the Court determined that the Secretary violated the rule making process in  previous denials for presumptive disabilities related to Vietnam veterans.

 

The VA had previously held that to eligible for benefits based on these presumptions, the veteran must have physically stepped foot on land in Vietnam. The court is presently holding that the waters thereof  should be included.

 

As the VA will most likely appeal this decision we want to encourage every veteran to reopen or file a claim before this law changes and takes effect, so that they may be afforded the benefits they are entitled to.
